How does it work in practice?
Is it legal to have a UK Limited while being tax resident in Spain?
Yes, completely. You're tax resident in Spain and pay tax on your personal income here (salary or dividends received from your UK Limited), but the company pays Corporation Tax in the UK. This is a structure thousands of Spanish freelancers and founders have used for years. What matters is correctly declaring everything you receive from the company on your Spanish IRPF (personal income tax) return.
How do I get paid my salary from the UK Limited in Spain?
There are two main options: (1) a monthly salary from the company with IRPF withholding, or (2) dividends at the end of the tax year (more tax-efficient, since they're taxed at the savings rate). Aiden helps you choose the optimal combination based on your revenue.
What about the self-employed social security contribution? Do I still have to pay it?
No. If your only source of income is as the director/sole shareholder of your UK Limited, you deregister as self-employed in Spain. You do need to keep making minimum contributions to maintain healthcare coverage and benefits. Aiden advises you on the most efficient structure.
Is there a risk of double taxation?
